TreSource Inc. maintains this website, any courses offered and other linked and related sites (the “Site”) for the use of its customers, vendors, students, and other Site users (“Users”) upon agreement to the following terms. Please read the terms carefully before using the Site. Use of this website indicates acceptance of these “Terms of Use” and forms a binding agreement between you and TreSource, Inc. If you do not agree to these terms, do not use this Site.
1. Copyright and Confidentiality Notice
TreSource, Inc. provides various materials, information, quizzes, tests, questions, articles, news and other information on this and related sites and in courses offered through this site (the “Materials”). TreSource, Inc. authorizes each User to view and download one copy of the Materials. Materials used in each training are the confidential and exclusive copyrighted and proprietary intellectual property of TreSource, Inc. These materials are provided to me by TreSource, Inc. and solely intended for my personal use as a webinar training participant. No part of these documents and/or resources can be stored, reproduced or transmitted in any form or by any means (electronic, photographic, mechanical, or any other medium), recorded, translated, or used to produce any derivative works without the explicit written permission of TreSource, Inc., under signature. Any violation, or the likelihood of violating, any of my agreements contained in this paragraph, would automatically terminate my authorized use of the Site and would entitle TreSource, Inc. to injunctive relief to prohibit any such violations. Should TreSource, Inc. commence any legal action in response to my act or omission in violation of this provision, I shall pay all of TreSource, Inc. legal fees and court costs, in addition to all damages requested by TreSource, Inc.
2. Right to Photos & Video
I hereby expressly grant to TreSource, Inc. and to its officers, employees, agents, and assignees the right to capture, record, and use photographs, video, and/or audio impressions (including live or on the Thinkific website) of me (collectively, “Impressions”) recorded by TreSource, Inc. during trainings. I understand these images/sounds may be used for educational or informational purposes. I shall not be entitled to any royalties, fees, or other compensation or notice, in connection with any such use. In addition, I waive any claims that any use of my photograph, image, and or voice as permitted hereunder portrays me in a derogatory manner or false light.
3. Videoconference
If I participate in a training by videoconference, I will not display any background that includes any copyrighted image or logo that I do not own. If I own an image or logo that I display as part of a background, I hereby grant TreSource, Inc. a royalty-free and irrevocable license to use said image and/or logo captured as part of the Impressions as otherwise permitted hereunder.
4. Appropriate Conduct
As a participant, I agree to uphold the following rules during all training sessions:
- Maintain privacy of others. Other participants may ask personal questions or share private information. Respect the privacy of others and keep all information within the group.
- Be respectful. This is a place to learn, share, encourage, and collaborate with each other. Inappropriate language, rude remarks, or negating another's experience will not be tolerated and may result in dismissal from the session and/or course.
- No promotions or spam. Self-promotion, spam, and irrelevant links aren’t allowed in the discussion or chat room. No links to products, websites, training, Facebook pages and affiliate links.
- No private messaging fellow participants you don't know. Please don't offer to send information privately or spam participants within their inbox. Share openly within the group for all participants to benefit from. No exceptions.
5. Due Diligence
All content found on the TreSource, Inc., including: text, images, audio, or other material contained on this website are for informational purposes only. I agree that I am solely responsible for doing my own due diligence when it comes to making career, business, and/or financial decisions and the information, products, and services that have been provided by TreSource, Inc. or during a training should be independently verified by my own qualified professionals including checking with my accountant, lawyer or professional advisor, before acting on this or any information.
6. Hyperlinks
Links to external websites are provided solely as a convenience to me. TreSource, Inc. has not reviewed all of these external websites, does not control and is not responsible for any of these sites or their content. If I decide to access any of the external websites linked to this Site, I do so entirely at your own risk.
6. No Guarantees
From time to time, TreSource, Inc. may report on the success of one of its existing or prior customers. The information about this success is accurately portrayed by the Customer. I acknowledge that the prior success of others does not guarantee my success. As with any business, my results may vary and will be based on my individual capacity, business experience, expertise, and level of desire. There are no guarantees concerning the level of success I may experience. Each individual’s success depends on his or her background, dedication, desire, and motivation.
7. Limitation of Liability
TreSource, Inc.’s information, products, and services should be carefully considered and evaluated, before reaching a business decision, on whether to take any action (or refrain from acting). I agree that TreSource, Inc. is not responsible for the success or failure of my business decisions relating to any information presented during a training or elsewhere by TreSource, Inc. or others, or TreSource, Inc.’s products or services.
8. Continuing Education Units
In order to obtain a continuing education unit (CEU) I must abide by the BACB's guidelines as follows:
- Attend each training session in it's entirety
- Provide my name and BACB certification number
- Provide evaluative feedback at the conclusion of a training session
I agree that offerings for continuing education units are clearly identified and the appropriate target audience is identified. Violation of the outlined requirements for obtaining CEUs will result in failure to obtain such units. Refunds or credits will not be issued in such cases.
9. Applicable Law
The Terms of Use are governed by the laws of the state of California. Failure to enforce strict performance of the Terms of Use of Use shall not be construed as a waiver of any provision or right. TreSource, Inc. may assign its rights and duties under the Terms of Use without notice to any party at any time.
10. Effective Date and Updates
The Terms are effective as of October 2, 2020 and are subject to change without notice by TreSource, Inc. at any time. Please check for changes regularly. Your use of this Site after such changes constitutes your agreement to such changes.
